A parenting plan is typically established by the court, and a parent plan basically outlines what the parents’ parental responsibility and visitation schedule would be. Parental responsibility meaning which parent or both of the parents decision-making authority to make decisions in regards to the child or children’s health care, education, religion, any major decisions that would affect the welfare of the child. Basically a visitation schedule is also established in the parenting plan, which will include a regular visitation schedule as well as a holiday schedule. The main goal of the parenting plan is to address all major issues in regards to the child in what is in the best interest of that child.
While the foreclosure case is pending, homeowners and tenants are permitted to stay at the property as the home still belongs to the homeowner while the foreclosure action is pending. A homeowner or a tenant, they’re not required to vacate the property until the property is actually sold at a foreclosure sale. Of course, there are exceptions to this. However, that is the general rule is once the property is sold, then a new owner will assume the property.
If you file for bankruptcy while a foreclosure case is pending, your foreclosure case is going to stop. That’s because when you file for bankruptcy, you’ll be entitled to what is known as an automatic stay on your legal proceedings. However, the bankruptcy protection is to be used as a shield only. A lot of times people use it as a sword and use it as a way to stop their foreclosure case in bad faith. Do not do this or you might be subject to other penalties.
There are a number of documents that you would have to file with the court in order to obtain a divorce. The most important document, of course, is a Petition for Dissolution of Marriage but there are some other required documents, a Notice of Social Security, if there are minor children involved in the action. Then you would also have to file a UCCJEA, a notice of related case is also required.
You can pick up a packet from the local County Courthouse where you can fill out that they would provide all of the documents. You can fill it out and file it with the court, but I would recommend that you seek an attorney with filling out these documents, or with obtaining representation as it is important that you list the necessary relief that you’re seeking for the court to grant.
